The fair treatment of HOA community members is not only ethical, it can help you avoid legal trouble. When rules are enforced differently for some members but not others, it can create tension and dissatisfaction. Some members may become so distraught they seek legal help which can end up being costly for the HOA.
When the board expects only certain members of the community to follow the rules, it’s called selective enforcement. Some board members do this purposely to protect themselves or their friends. Others do it unintentionally.
It can feel like second nature to protect those who are near and dear to you. But, this isn’t fair and can get you into trouble. Community members need to be treated equally. That means the rules apply to everyone in the community, including the board, their friends, and their family.
How do you make sure that rules are enforced the same way every time? It’s best to consult your governing documents regarding what the rules are and what the consequences are when someone violates them. Every board member should have a thorough understanding of what’s in the governing documents. When a rule is broken, look back at them to make sure you initiate the correct protocol. This allows you to ensure that every case is handled the same way.
Now, there may be times when a board member doesn’t feel they can make a decision fairly because the person is too close to them. If that’s the case, it’s best for the board member to speak up and voluntarily remove themselves from the decision-making process.
There may be cases where a community member accuses the board of unfair treatment. It’s best in these situations to listen to what the member has to say. Sometimes, they just want someone to listen to them. If you don’t make time for them, they could end up feeling the need to seek outside help (such as legal assistance). Whereas, hearing them out could potentially de-escalate the issue.
To protect your HOA board, always save records from your interactions with community members. By keeping records, you can provide proof that all members are treated fairly if a case should be brought against you.
